Recent legislations have liberalized "Litigation and Arbitration Funding" for Third Party Funders (TPF) drastically in Hong Kong and Singapore. In short, those arbitral parties who are short of funds could seek TPF to provide funding for the purpose of Arbitration now lawfully.
This would also provide opportunities for investors as well as construction companies who have good claims but short of funding. All of which are now legally regulated under the Arbitration Ordinance (Cap. 609, laws of Hong Kong). TPF for arbitration and insolvency litigation, provide an exception to general prohibition of maintenance and champerty at common law.
Arbitration finance is definitely a new and powerful tool for prospective arbitral parties particularly for construction companies. The seminar speaker Mr George Chu, Barrister practicing since 1994 who is very experienced in this new development and will shed lights on how and why companies should seek third party funding in Arbitration.
